Adjustment to schedules

Are managers able to do schedule adjustments to cover times when LPNs would have been providing coverage? Specifically, changing start or end times for shifts? I would not think this would be allowable but was hoping for additional confirmation.

Hi and thank you for your question.
Managers are to follow the Collective Agreement in terms of scheduling and changing of scheduling. Under the law, capable and qualified non-union management employees are expected to do the work of striking employees.
AUPE’s ESA states clearly: “During a strike or lockout at a site, the Employer shall not … assign work that would normally be performed by an employee in the bargaining unit that is on strike or lockout to employees in other bargaining units.”
If the Manager does change your shift schedule time and if the change is not in accordance with the Collective Agreement I suggest you reach out to your LRO at that time with the specific details.
